What is the JUUL E-Cigarette?
JUUL e-cigarettes are a nicotine-delivery system that are shaped much like a USB drive. It is widely used as an alternative to traditional cigarettes. The device uses a heating element—run by battery—that vaporizes a nicotine-infused solution into an aerosol that is inhaled, delivering much of the same effects that smoking a traditional cigarette would to the user.
E-cigarettes continue to be a popular form of nicotine delivery, and JUUL capitalized on that fact. Currently, the company holds more than 50 percent of shares within the e-cig market, a market expected to be worth $86.43 billion by 2025. Due to the popularity of this particular device since it hit the market in 2015, sales are expected to reach $43 billion and more in the near future.
Because of its spreading popularity, JUUL e-cigarettes have become more accessible for teenagers, enticing them with such flavors like crème brulee and mango that encourage them to vape. These flavors come in what are called “JUUL Pods,” small cartridges that contain nicotine salts and flavorings with a mouthpiece attached.
The Dangers JUUL E-Cigarettes Present
At first, e-cigs were advertised as a “safer” alternative to help people who were trying to quit smoking. Since there is no flame that is used, smoke, tar, and other carcinogenic substances aren’t created as they are in traditional cigarettes, but that doesn’t mean that e-cigs contain zero risk of developing health complications.
Nicotine salts are what make JUUL e-cigs particularly dangerous to our youth. Nicotine salts are essentially a concentrated dose of nicotine that can be several times higher than what you would normally find in one traditional cigarette. This super concentration of nicotine—sometimes as high as 59 milligrams of nicotine per milliliter of liquid compared to the industry standard between 6 and 30 milliliters—can effectively cause nicotine addiction which comes with its own associated health complications such as:
- Altered Brain Development
- Reduced Immune Response
- Developmental and Reproductive Problems
- Increased Risk of Traditional Cigarette Use
- Coronary Vascular Disease
- Acute Myocardial Ischemia
- Peripheral Arterial Disorders
- Chronic Obstructive Pulmonary Disease
- Inflammatory Lung Diseases
Another potential risk lies in the solution that contains the nicotine, itself, made of propylene glycol, glycerol, and other flavoring substances. When heated, propylene glycol can potentially produce formaldehyde-releasing agents, a well-known carcinogen linked to certain cancers.
Not long ago, a particular buttery flavor found in e-juice—the official name of the nicotine/propylene glycol solution—called diacetyl was also discovered to be the cause of a condition known as “popcorn lung,” or bronchiolitis obliterans. Diacetyl was a flavoring used in popcorn factories that caused the mixers to develop potentially lethal lung diseases, and some e-juice manufacturers have been found to use this ingredient.
E-cigs also contain a small risk of explosion if the battery used isn’t compatible with the rest of the setup, was overcharged, is improperly stored, or was charged using the wrong charging device. This can cause:
- Severe Burns
- Scarring
- Disfigurement
- Oral Injuries
- Hand and Finger Injuries
- Amputations
- Eye Injury
- Potential Vision Loss
- Tooth Damage or Loss
More on the JUUL Lawsuit
Families of the nation’s youth who use—or have used—JUUL are coming forward with allegations that JUUL Labs engaged in deceptive marketing practices that encouraged young people to buy their product through suggestive labeling and advertising.
The plaintiffs in these lawsuits claim that JUUL Labs knew that their product was not safe for non-smokers and could reignite nicotine addiction in users who were already addicted to traditional cigarettes. They also allege that JUUL Labs knew how well its potent nicotine solution was at nurturing nicotine addiction at a quicker and much more efficient manner than any traditional cigarette.
To make matters worse, the lawsuit alleges that JUUL continued to provide false, misleading, and/or deceitful information via their product website, social media, advertisements, and interviews.
Now, class action lawsuits are being filed against the e-cigarette provider, which may sound off an important message to companies that put profits over people. However, joining a class action lawsuit can effectively undercut the monetary value of your claim. That’s why hiring an experienced JUUL e-cigarette lawsuit attorney from Spiros Law, P.C. is your best option at getting the full amount you deserve.
Determining Liability in a Product Liability Claim
In order for full compensation to be awarded to the victim of a product liability claim, an experienced product liability lawyer must determine what kind of product liability claim the accident fits under.
There are three types of product liability claims that a lawyer must consider:
- Strict Liability
- Negligence
- Breach of Warranty
With strict liability, the claim focuses on the product itself. This claim disregards any actions made by the company that sells it, the manufacturer that makes it, or the supplier that distributes it. This type of claim requires that the product liability lawyer must prove that a defect was created during the product’s design or manufacturing process that made it unreasonably dangerous and caused injury to the user.
Negligence, on the other hand, requires that a product liability lawyer prove that the manufacturer of the product neglected to provide reasonable care in the product’s designing, manufacturing, and/or marketing processes. It is then up to the lawyer to prove that their client’s injury was sustained because of this lack of reasonable care.
Finally, a lawyer may also examine if the company committed a breach of warranty. A warranty is somewhat of a promise to the consumer that the product they are using is safe so long as it is used in the manner that was intended. An experienced product liability lawyer would have to prove that the company broke this warranty, which caused injury to the victim.
